A grocery store employee mopped the floor in Aisle 4 and placed a "Wet Floor" sign at one end of the aisle. A customer entered the aisle from the opposite end, slipped on the wet floor, and broke her wrist. In a negligence action against the store, the most critical issue will be whether:

A landowner stored 5,000 gallons of industrial solvents in an above-ground tank on his rural property. After an unusually heavy rainstorm, the tank ruptured and the chemicals contaminated a neighboring farmer's well water. The farmer sues the landowner. Under the Restatement (Second) of Torts approach to strict liability, the farmer will most likely prevail if he can show that:

A consumer purchased a new blender from a retail store. On first use, a blade detached from the base and cut the consumer's hand. A newspaper published an article falsely accusing a local school teacher of embezzling PTA funds. The teacher, who is not a public figure, sues the newspaper for defamation. To prevail, the teacher must prove:

How to Prepare for the Multistate Bar Exam

The Multistate Bar Examination (MBE) is a 200-question, multiple-choice test administered as part of the Uniform Bar Examination in most U.S. jurisdictions. It covers seven foundational subjects: Civil Procedure, Constitutional Law, Contracts (including UCC Article 2), Criminal Law and Procedure, Evidence, Real Property, and Torts. The MBE is scored separately, and your scaled MBE score constitutes half of your total UBE score in most states — making it one of the most consequential exams in your legal career.

Understanding the 7 MBE Subjects

Each MBE subject contributes approximately 25 scored questions. Torts questions test negligence, strict liability, intentional torts, products liability, and defamation. Constitutional Law covers individual rights (First Amendment, due process, equal protection) and federal powers (Commerce Clause, spending power). Contracts spans formation, consideration, the Statute of Frauds, UCC Article 2, breach, and remedies. Criminal Law and Criminal Procedure address homicide, theft offenses, inchoate crimes, and Fourth, Fifth, and Sixth Amendment protections. Evidence focuses on relevance, hearsay and its exceptions, character evidence, privileges, and expert testimony under the Federal Rules. Civil Procedure covers jurisdiction, pleading standards, discovery, summary judgment, and claim/issue preclusion. Real Property includes estates, future interests, landlord-tenant law, easements, and recording statutes.

MBE Question Format and Timing

Each MBE question presents a fact pattern followed by a call of the question and four answer choices (A through D). Questions are designed so that multiple answers may seem plausible, but only one is the "best" answer under the majority rule or the rule specified in the question. You have 3 hours per session (100 questions), giving you approximately 1 minute and 48 seconds per question. Effective time management is critical: many students lose points not because they do not know the law, but because they spend too long on difficult questions and rush through the rest.

Proven Study Strategies

The single best predictor of MBE success is the number of practice questions you complete with careful review. Studies of bar exam takers consistently show that students who complete 1,500–2,000 practice questions outperform those who rely primarily on passive review methods like reading outlines or watching lectures. The reason is straightforward: the MBE tests your ability to apply rules to novel fact patterns under time pressure, and that skill is built through repetition, not memorization alone.

Structure your preparation in three phases. First, learn the black-letter law for each subject using concise outlines — not entire treatises. Second, begin practicing questions subject by subject, reviewing every explanation thoroughly, including for questions you answered correctly. Third, shift to mixed-subject timed sets that simulate exam conditions, training yourself to switch between legal frameworks quickly. Throughout this process, keep an error log tracking the specific rules and question types you miss most frequently, then target those weaknesses with additional focused practice.

Why Practice Questions Matter Most

Active retrieval practice — testing yourself rather than re-reading — is the most effective learning technique documented in cognitive science research. Every time you work through an MBE-style question, you strengthen neural pathways associated with identifying the relevant legal issue, recalling the applicable rule, and applying it to a new set of facts. Over time, this process becomes automatic, allowing you to read a fact pattern and immediately recognize the controlling doctrine. That speed and accuracy is what separates students who pass comfortably from those who fall short.
